Terms of Service

By downloading, installing, or using Musical Pets (the "Application"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Application.

These Terms constitute a legally binding agreement between you and Toastfield ("we," "us," or "our"). Your continued use of the Application constitutes ongoing acceptance of these Terms.

Musical Pets is an iOS idle life simulation game in which your Apple Music listening history shapes a procedurally generated world of creatures, biomes, and ecosystems. The game reads metadata from your Apple Music library on-device (genres, artists, play counts) to generate your unique world. This data is never transmitted to our servers.

The Application is available on iOS only. No account is required to use the Application.

Musical Pets is rated for general audiences (Apple App Store 4+) and does not require an account or collect personal information, so there is no minimum age to play it — the minimum age required by the Apple App Store to download apps generally is the effective floor. If you are under 18, you should use the Application with the awareness of a parent or guardian, particularly with respect to the optional Apple Music integration described below.

Use of Musical Pets's Apple Music integration requires a valid Apple Music subscription or an iTunes music library on the same Apple ID, which is subject to Apple's own age requirements for Apple ID and Apple Music.

You agree to use the Application only for lawful, personal, non-commercial purposes. You agree not to:

• →Attempt to reverse engineer, decompile, or disassemble any part of the Application
• →Modify, adapt, or create derivative works based on the Application
• →Exploit bugs or unintended behaviors to gain unfair advantages
• →Use automated tools to interact with the Application
• →Use the Application for any illegal or unauthorized purpose

With your permission, Musical Pets uses Apple's MusicKit framework to access metadata from your Apple Music library (genres, artists, and play counts) for the purpose of generating your in-game world. This access is governed by Apple's terms and requires an active Apple Music subscription or iTunes library.

This music metadata is processed entirely on your device and is never transmitted to Toastfield's servers. You may revoke the Application's access to your Apple Music library at any time in your device's Privacy settings. Revoking access will prevent new world generation but will not delete your existing game data.

We are not affiliated with or endorsed by Apple Music or Apple Inc. in providing this feature.

The Application currently has no in-app purchases — it is entirely free to play, and in-game currencies are earned through gameplay only. If we introduce optional in-app purchases in the future, they will be processed by Apple via StoreKit and subject to Apple's App Store Terms and Conditions; we would not receive your payment card information, purchases would be final, and refunds would be handled entirely by Apple in accordance with Apple's refund policy.

The Application and all content — including creature designs, biome artwork, game mechanics, code, music, and trademarks — are owned by Toastfield or its licensors and are protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Application on your personal iOS devices for personal, non-commercial purposes, subject to these Terms.

You may not copy, modify, distribute, sell, or create derivative works from any part of the Application without our prior written consent.

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Game data (creatures, world state, progress) is stored locally on your device using SwiftData. We are not responsible for data loss resulting from device failure, iOS updates, app deletion, or other factors outside our control. We recommend regularly backing up your device via iCloud or iTunes.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TOASTFIELD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE APPLICATION, INCLUDING LOSS OF GAME PROGRESS OR IN-APP PURCHASE CONTENT.

Our total liability to you shall not exceed USD $50 (the Application currently has no in-app purchases; if that changes, this cap will be the greater of USD $50 or the amount you paid for in-app purchases in the twelve months preceding the claim).

We may update, suspend, or discontinue the Application at any time. Because Musical Pets does not require an account and stores all data locally, termination of the Application would only prevent future use — your existing local data would remain on your device until you delete the app.

We reserve the right to remove the Application from distribution at any time for any reason.

These Terms shall be governed by the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved in the state or federal courts located in California.

We may update these Terms from time to time. We will notify you of material changes by updating the effective date above and, where appropriate, through an Application update notice. Your continued use of the Application after any changes constitutes acceptance of the revised Terms.
