Terms of Service

By accessing or using the Toastfield website (the "Site") or any mobile application published by Toastfield, including Pet Horoscope, Musical Pets, PolicyLens, Clarity, and Chartform (collectively, the "Applications"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Site or Applications.

These Terms constitute a legally binding agreement between you and Toastfield ("we," "us," or "our"). The minimum age to use each Application depends on that Application's App Store age rating and content — see each Application's own Terms of Service (linked from its page) for its specific eligibility requirement. If you are under 18, you must have parental consent to use any Application that requires an account.

Toastfield provides digital services including app development, web design, UI/UX design, automation, IT consulting, and fractional CTO services (the "Services"). We also publish and maintain mobile applications available on the Apple App Store and Google Play Store.

Our published applications include:

• →Pet Horoscope: An iOS application providing astrological readings for pets.
• →Musical Pets: An iOS idle game where Apple Music listening shapes a virtual pet world.
• →PolicyLens: An iOS application for browsing and visualizing U.S. government public datasets.
• →Clarity: An iOS decision journaling and goal-alignment application.
• →Chartform: An iOS application for turning CSV and Excel files into charts, entirely on-device.

We reserve the right to modify, suspend, or discontinue any Service at any time without notice.

Minimum age requirements vary by Application, because some Applications (like Pet Horoscope) require an account and collect personal information, while others (like Musical Pets, PolicyLens, Clarity, and Chartform) are rated for general audiences and collect no personal information at all. See each Application's own Terms of Service for its specific minimum age. Where an Application requires an account, you must be at least 13 years of age to create one; if you are between 13 and 18 (or the applicable age of majority in your jurisdiction), you must have the permission and supervision of a parent or legal guardian.

Applications that require an account are not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13 through them. If we learn that we have collected personal information from a child under 13, we will delete it promptly.

None of our Applications currently require you to create an account with us. Pet Horoscope instead uses your device's existing iCloud sign-in (via Apple's CloudKit) to sync your data through your own private iCloud account — we do not maintain a separate account system, and we do not receive your Apple ID, email, or password. If we introduce an account system requiring registration with us in any Application in the future, this section will be updated to describe your related responsibilities and rights before that ships.

You may request deletion of any data an Application has stored on your behalf — whether in your own iCloud account or locally on your device — at any time through that Application's settings or by contacting us at info@toastfield.com.

You agree not to use our Site or Applications to:

• —Violate any applicable law or regulation
• —Impersonate any person or entity or misrepresent your affiliation
• —Transmit any unsolicited commercial communications (spam)
• —Attempt to gain unauthorized access to any part of our systems
• —Reverse engineer, decompile, or disassemble any Application
• —Scrape, crawl, or index our Site or Applications by automated means
• —Interfere with or disrupt the integrity or performance of our Services
• —Upload or transmit any malicious code, viruses, or harmful content
• —Harass, abuse, or harm any other user

All content on the Toastfield Site and within our Applications — including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software — is the property of Toastfield or its content suppliers and is protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use our Applications for their intended personal, non-commercial purposes. This license does not include the right to: (a) sell, resell, or commercially exploit any Application; (b) copy or use any portion of our Applications other than as expressly permitted; (c) use any data mining, robots, or similar data gathering tools.

"Toastfield" and associated logos are trademarks of Toastfield. You may not use our trademarks without our prior written consent.

Some Applications allow you to create, upload, or store content ("User Content"), including pet profiles, field notes, decision entries, and similar data. You retain ownership of your User Content.

By creating User Content in our Applications, you grant us a limited license to store and process that content solely for the purpose of providing the Application's features to you. We do not use your User Content for any other purpose.

You are solely responsible for your User Content and the consequences of sharing it. You represent and warrant that you have all necessary rights to your User Content and that it does not violate any third-party rights or applicable laws.

Some of our Applications may offer optional in-app purchases ("Purchases"). As of the effective date above, none of our Applications currently offer any in-app purchase — all are free to use. If we introduce Purchases in any Application in the future, they will be processed by the respective app platform (Apple App Store or Google Play Store) and subject to that platform's terms and conditions, and we will update these Terms and the relevant Application's Terms first.

Prices for Purchases are displayed within the Application. All fees are stated in U.S. dollars unless otherwise indicated and are exclusive of taxes where applicable. We do not process payment information directly — all payment handling is performed by Apple or Google.

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current subscription period. Refund requests must be directed to the relevant platform (Apple or Google) in accordance with their refund policies.

Our Applications are available through third-party app stores (Apple App Store, Google Play Store). Your use of these stores is subject to their respective terms of service. These Terms are between you and Toastfield only; the app store providers are not parties to this agreement.

We may update our Applications from time to time. Certain updates may be required to continue using the Application. We are not obligated to provide any updates, and we may discontinue any Application at any time.

You acknowledge that Toastfield may access and adjust your Application's content remotely (e.g., to provide updated horoscope data, updated datasets, or bug fixes) without requiring a manual App Store update.

OUR SITE AND APPLICATIONS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that: (a) our Services will be uninterrupted or error-free; (b) any content is accurate, complete, or current; (c) our Services are free of viruses or other harmful components.

Astrological content in Pet Horoscope is provided for entertainment and informational purposes only. It does not constitute veterinary advice. Always consult a licensed veterinarian for health concerns about your pet.

Government datasets provided through PolicyLens are sourced from data.gov and other public APIs. We do not warrant the accuracy, completeness, or timeliness of this data. Always verify data from official government sources before making decisions based on it.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TOASTFIELD, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• —Your access to or use of (or inability to access or use) our Services
• —Any conduct or content of any third party on our Services
• —Unauthorized access, use, or alteration of your transmissions or content
• —Any other matter relating to our Services

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability is limited to the maximum extent permitted by law. In all other cases, our total liability to you for all claims shall not exceed $100 USD or the amount you paid us in the last 12 months, whichever is greater.

You agree to defend, indemnify, and hold harmless Toastfield and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your violation of these Terms; (b) your User Content; or (c) your violation of any third-party rights.

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use our Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You may stop using our Services at any time. To request deletion of your account and data, please use the in-app account deletion feature or contact us at info@toastfield.com.

These Terms shall be governed and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions.

We want to resolve any disputes amicably. Before filing a claim, you agree to first try to resolve the dispute by contacting us at info@toastfield.com. We will try to resolve the dispute within 30 days.

If we cannot resolve the dispute informally, any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered in accordance with the American Arbitration Association's Consumer Arbitration Rules, rather than in court.

You may opt out of arbitration by sending written notice to info@toastfield.com within 30 days of first accepting these Terms. If you opt out, disputes shall be resolved exclusively in the state or federal courts located in California.

YOU AND TOASTFIELD AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

We reserve the right to update or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect, via the Application or our website. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms.
