Terms of Service

By downloading, installing, or using PolicyLens (the "Application"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Application.

These Terms constitute a legally binding agreement between you and Toastfield ("we," "us," or "our").

PolicyLens is an iOS application that provides access to U.S. government open datasets, searched via the Socrata Discovery API and retrieved from individual government agencies' open-data portals (many of which also appear in the data.gov catalog). Users can search the catalog, view dataset metadata, visualize data with interactive charts, and save favorites locally on their device.

No account is required to use the Application. The Application does not collect any personal information.

The Application is intended for general audiences. You must be at least 13 years old to use the Application. By using the Application, you represent that you meet this requirement.

You agree to use the Application only for lawful, personal purposes. You agree not to:

• →Use the Application for any illegal or unauthorized purpose
• →Attempt to reverse engineer, decompile, or disassemble the Application
• →Use automated tools to scrape or extract data in ways that violate the data.gov API terms
• →Interfere with or disrupt the Application or the data.gov API infrastructure
• →Represent that data obtained through the Application is your own original work

The Application retrieves dataset information from the Socrata Discovery API (operated by Socrata / Tyler Technologies) and directly from individual government agencies' own open-data portals. This is public information maintained by government agencies, many of which is also indexed in the data.gov catalog, and is subject to Socrata's and each agency's own terms of service and applicable federal, state, or local data policies.

Toastfield is not responsible for the accuracy, completeness, or availability of datasets retrieved through the Application. We make no representations regarding the quality or reliability of any government data retrieved through the Application.

Your use of government datasets retrieved through the Application may be subject to the individual dataset's license terms, which are displayed in the Application where available.

The Application — including its design, code, charts, and all non-government content — is owned by Toastfield and is protected by applicable intellectual property laws.

Government datasets retrieved through the Application are published by the U.S. federal government and are generally available under open data licenses. Refer to individual dataset metadata for applicable license terms.

We grant you a limited, non-exclusive, non-transferable license to use the Application on your personal iOS devices for personal, non-commercial purposes, subject to these Terms.

THE APPLICATION IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF ANY DATASET OR INFORMATION RETRIEVED THROUGH THE APPLICATION.

Data availability depends on the Socrata Discovery API and individual government agencies' open-data portals. We are not responsible for service interruptions caused by downtime, API changes, or removal of datasets from any of these catalogs.

PolicyLens is not affiliated with, endorsed by, or sponsored by the U.S. General Services Administration, data.gov, Socrata, or any government agency.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TOASTFIELD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE APPLICATION OR ANY GOVERNMENT DATA ACCESSED THROUGH IT.

Our total liability to you shall not exceed USD $50.

We may update, suspend, or discontinue the Application at any time. Because PolicyLens does not require an account and stores all data locally, termination would only prevent future use. Locally saved favorites would remain on your device until you delete the app.

These Terms shall be governed by the laws of the State of California, without regard to its conflict of law provisions. Any dispute shall be resolved in the state or federal courts located in California.

We may update these Terms from time to time. We will notify you of material changes by updating the effective date above. Your continued use of the Application constitutes acceptance of any revised Terms.
